1. Our role as a third-party platform
Gemazaar (the “Platform”, “we”, “us”) is an independent, third-party software platform. We provide the website and the tools that let approved sellers publish gem listings and let registered buyers place bids in real time.
We do notown, store, value, certify, photograph, transport, or insure any gem listed on the Platform. We do not collect bidding deposits, do not process the final payment between buyer and seller, and do not act as an escrow agent. The marketplace is fully automated — bids are recorded the instant they are submitted, and the highest bid at the close of the auction is recorded as the winning bid. After that, the buyer and the seller deal with each other directly to complete the transaction.
2. Eligibility & account
To use the Platform you must be at least 18 years old (or the age of legal majority in your jurisdiction) and able to enter into a binding contract. You agree to provide accurate, current information at sign-up and to keep that information up to date.
Anyone can register as a buyer. To list gems you must additionally complete seller onboarding (identity documents, business name, contact details) and wait for the on-platform review to approve you. We may decline or revoke seller approval at our sole discretion.
3. Mobile number requirement
A working mobile telephone number is mandatory before you can place any bid or use the Buy Now option. Sellers see the winning buyer’s name, email and mobile after the auction closes so they can complete the sale. If you do not provide a mobile number, the bid form will be blocked.
You can add or update your mobile number any time in your Profile.
4. Listings posted by sellers
Every listing — including photographs, videos, descriptions, weights, origin, treatments, certifications and starting price — is uploaded and controlled by the seller. We do not independently verify the accuracy of listing content. Buyers should read the listing carefully, ask the seller questions if needed, and only bid an amount they are comfortable paying.
If a listing appears fraudulent or violates these terms, please report it using the contact details below and we will investigate.
5. Placing a bid
A bid is a binding offer. When you click Place Bid or Buy Nowyou are stating that you intend to purchase the gem at that price if you are the winning bidder, in accordance with the seller’s listed terms (returns policy, shipping option, etc.).
By submitting a bid you confirm that:
- You have read this entire Terms & Conditions page.
- You understand the Platform does not take responsibility for the gem or for the transaction itself.
- You have provided a working mobile number so the seller can contact you if you win.
- You have the financial means to honour your bid.
6. Winning a bid — buyer & seller contact
When an auction ends, the highest bidder is shown as the winner inside the listing. The winning buyer and the seller can then see each other’s name, email and mobile number on the listing page so they can continue the transaction privately.
We do not arrange the meeting, the inspection, the payment, the customs paperwork or the shipping. Those arrangements are a private matter between the buyer and the seller. The Platform’s role ends the moment the auction closes.
7. Payment, shipping & disputes
Gemazaar does not handle money on behalf of buyers or sellers. There is no payment gateway, no escrow service, no refund processing and no shipping tracking on the Platform. All payment, packaging, shipping, insurance, taxes, duties, and after-sales support are agreed and executed between the buyer and the seller directly.
Any dispute about the gem — condition, authenticity, weight, treatment, payment, delivery, returns — must be resolved between the buyer and the seller. We may, at our sole discretion, share basic listing data with the parties to help, but we do not arbitrate.
8. No liability for goods, money or losses
You use the Platform at your own risk. To the maximum extent permitted by law, Gemazaar is not liable to any user, seller, buyer or third party for:
- The authenticity, quality, value or legal status of any gem listed.
- Misrepresentation, fraud, or non-delivery by a seller.
- Non-payment, chargeback, theft, or fraud by a buyer.
- Loss, damage, theft or seizure in transit.
- Loss of profit, loss of business, indirect or consequential losses.
- Service interruptions, data loss, or bugs in the auction software.
The Platform is provided “as is” and “as available”, without warranty of any kind. Where local law does not allow the exclusion of certain warranties or liabilities, those exclusions apply only to the extent permitted.
9. Prohibited use
You must not use the Platform to:
- List stolen, smuggled, synthetic-as-natural, or illegally sourced gems.
- Manipulate bids (shill bidding, fake accounts, coordinated rings).
- Harass, threaten, dox, or otherwise harm another user.
- Bypass the bidding mechanism or contact other buyers off-platform with the intent of disrupting an auction.
- Scrape, copy, or republish listing media without the seller’s permission.
10. Suspension & account removal
We may suspend or permanently delete any account at our sole discretion, with or without prior notice, if we believe it has violated these terms. When a seller account is removed, that seller’s listings, photographs, videos and other uploaded files are deleted from our storage and from connected services such as Cloudflare Stream.
You may close your own account at any time by contacting us. Closing your account does not retroactively cancel bids that you already won, nor does it resolve transactions already in progress with sellers.
11. Changes to these terms
We may update these terms from time to time. The version live on this page is the version in effect. We recommend reviewing this page before placing a bid. Continued use of the Platform after an update constitutes acceptance of the new terms.
